With the release of the Immigration (Transition) (Amendment & Validation) Bill, 2025, many buyers, investors, and relocating families are asking what, if anything, has changed for real estate ownership and residency in the Cayman Islands.
The short answer? Very little has changed for property investors.
But there are some important clarifications worth understanding.
Here are 10 simple things you need to know, explained clearly and without legal jargon.
1. Permanent Residency Rules Have NOT Changed
This is the most important point.
The Government has confirmed that the Permanent Residency (PR) framework remains exactly the same. Any future changes to PR will come later, under separate legislation, not this Bill.
What this means:
If you were considering PR through investment before, the rules you understood still apply today.
2. Residency by Real Estate Investment Is Still One of Cayman’s Strongest Options
You can still qualify for Permanent Residence for Persons of Independent Means by investing a minimum of CI$2 million in developed real estate.
This pathway remains fully intact and protected under the law.
3. The Law Now Clearly Defines “Developed Real Estate”
The Bill clarifies what counts as developed property (for example, homes, condos, or completed buildings with a certificate of occupancy).
Why this matters:
It removes grey areas and gives buyers and developers clearer guidance—especially helpful for luxury and pre-construction purchases.
4. PR Certificates Are Now Issued for 10 Years (Renewable Indefinitely)
If granted PR through investment:
- Your certificate is valid for 10 years
- It can be renewed indefinitely
- After holding an indefinite renewal for one year, you may apply for Naturalisation if you wish
This creates a clear, predictable long-term pathway.
5. Some Residency Holders Must Now File a Simple Annual Declaration
New annual declarations are required for:
- PR holders (Independent Means)
- Direct Investment certificate holders
- Substantial Business Presence certificate holders
- Residency & Employment Rights Certificate (RERC) holders
- Spouses granted Caymanian status (first 7 years)
Important:
This is an administrative requirement, not a reapplication or reassessment.
6. Buying Property Is NOT Affected by the New Declaration Rules
Property ownership rights are not impacted by the annual declaration requirement.
If you legally own property in Cayman, your ownership is secure, regardless of immigration status.
7. Direct Investors Can Still Qualify for Residency
If you invest significantly in a Cayman business and employ Caymanians, the Certificate of Direct Investment remains available.
The only change is the addition of annual reporting to confirm ongoing compliance.
8. Spouses of Caymanians or PR Holders Now Have Clearer, Longer-Term Rights
Spousal residency certificates are now issued for 15 years, with the option to:
- Renew indefinitely
- Later apply for Naturalisation
This provides more certainty for families planning long-term life and property ownership in Cayman.
9. Work Permit Changes Don’t Affect Property Buyers Directly
Some work permit rules have tightened (such as limits on changing employers early), but these changes do not impact property ownership or PR through investment.
They are aimed at workforce stability, not investors.
10. Cayman Remains One of the Most Stable Residency-by-Investment Jurisdictions
